These Terms & Conditions ("Terms") govern your use of the Pudel website (pudel.com.au and any Shopify URL we operate) and every purchase you make from us. By using our website or placing an order you agree to be bound by these Terms. If you do not agree, do not use our website or purchase our products.
Pudel Pty Ltd (ABN 78 698 370 884) is an Australian company. These Terms are governed by the laws of New South Wales and the Commonwealth of Australia.
1. Your confirmations when you use this site or place an order
By browsing our website, creating an account, or placing an order, you represent and warrant to us that:
- you are at least 18 years of age;
- you have full legal capacity to enter into a binding contract: you are of sound mind and are not under any legal incapacity, guardianship order or other restriction that would prevent you from contracting;
- all information you provide to us (including your name, address, contact details and details about your dog) is true, accurate, current and complete, and you will keep it up to date;
- you are the authorised holder of, or are authorised to use, the payment method you nominate;
- you are purchasing for your own dog or a dog in your care, and not for resale unless we have agreed in writing;
- you have read the product description, feeding guide and suitability notes for each product before ordering; and
- you accept sole responsibility for choosing products that are appropriate for your dog's size, age, breed, health, dental condition and chewing style, and for how those products are stored, prepared and fed.
We rely on these confirmations to supply you. If any of them is untrue, we may cancel your order and refund you, and you will be responsible for any loss we suffer as a direct result.
2. Minors, parents and guardians
Our website and products are intended for adults. Persons under 18 are not permitted to create an account or place an order. If a person under 18 accesses our website or places an order, the parent or legal guardian who permitted that access, or whose payment method, account or address was used, is deemed to have accepted these Terms on the minor's behalf and is responsible for the minor's use of the website, for the order, and for the feeding and supervision of any product purchased. We may cancel any order we reasonably believe was placed by a minor.
3. Our products: what they are and what they are not
Our products are treats and chews for dogs made from single-protein, naturally dried Australian animal ingredients. They are supplementary treats, not a complete or balanced diet, and must be fed alongside your dog's regular food with fresh water always available. They are not veterinary products and nothing on our website is veterinary advice. Nutritional descriptions are general information only. If your dog has a health condition, allergy, sensitivity, dental issue or is pregnant, very young or elderly, consult your veterinarian before feeding.
Natural animal products vary in size, colour, shape, texture and hardness from piece to piece and batch to batch. This variation is normal and is not a defect.
4. Feeding, supervision and acceptance of inherent risk
Bones, tendons, horns, feet, necks and other natural chews carry inherent risks if they are unsuitable for a particular dog or are fed without supervision. Those risks include choking, tooth fracture, gum injury, digestive upset or obstruction. By purchasing you acknowledge these inherent risks and agree that you will:
- follow the feeding guide, suitability notes and any warnings on the product page and packaging;
- select the correct size and type of product for your dog;
- supervise your dog at all times while it is eating any product, and remove any piece that becomes small enough to swallow whole;
- never feed a chew to a dog that is unsupervised, has damaged or fragile teeth, is a known gulper, or has a history of obstruction;
- store products resealed, cool and dry, and discard any product that is past its best-before date or has been contaminated; and
- stop feeding and consult a veterinarian immediately if your dog shows any adverse reaction.
To the maximum extent permitted by law, you accept the inherent risks described above and agree that Pudel is not liable for loss, injury or damage that results from a failure to follow the feeding guide or suitability notes, from feeding an unsuitable product, or from feeding without supervision.
5. Products and pricing
All products are subject to availability. We may limit quantities or discontinue products at any time. Prices are in Australian dollars, inclusive of GST, and may change without notice; the price you pay is the price shown at checkout. We take reasonable care to describe products accurately but colour, size and appearance may vary from images.
6. Orders and contract
Your order is an offer to purchase. A contract is formed when we email your order confirmation. We may refuse or cancel an order where a product is unavailable, where there is a listing or pricing error, where we suspect fraud or a breach of these Terms, where payment cannot be verified, or where we reasonably believe the order was placed by a minor. If we cancel after payment we will refund you in full within 5 business days.
7. Payment
We accept the payment methods shown at checkout. Payments are processed by our third-party gateway; we do not store full card details. We may use fraud-screening services and may decline any transaction at our discretion.
8. Delivery
We ship within Australia only. We aim to dispatch orders as quickly as we reasonably can, and dispatch may take longer during peak periods, during sales, where an item is out of stock, or where an order requires verification. Any delivery timeframe shown on our website, at checkout or by the carrier is an estimate provided by the carrier and is indicative only; it is not a guarantee of a dispatch or delivery date. Shipping is free on orders over $75; otherwise a flat rate is calculated at checkout. You will receive a tracking link by email on dispatch. You are responsible for providing a correct, complete delivery address and for collecting or receiving the parcel; we are not liable for loss or delay caused by an incorrect address, an unattended delivery you authorised, a carrier delay, or events beyond our reasonable control. Risk in the goods passes to you on delivery to the address you nominated.
9. Returns, refunds and our guarantee
9.1 Australian Consumer Law. Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage, and to have products replaced if they fail to be of acceptable quality where the failure is not major.
9.2 Our 30-day guarantee. If something is not right with your order, email woof@pudel.com.au within 30 days of delivery with your order number and we will make it right: replacement, store credit or refund at our discretion. Because our products are food, we do not accept change-of-mind returns of opened product. Unopened product in original packaging may be returned within 30 days for store credit, with return postage at your cost unless the item was faulty or sent in error. Variation in the size, colour or appearance of natural products is not a fault.
10. Accounts
You are responsible for keeping your login details confidential and for all activity under your account, whether or not authorised by you. Tell us immediately if you suspect unauthorised access. We may suspend or close accounts used fraudulently or in breach of these Terms.
11. Promotions, discounts and bundles
Discount codes have no cash value, cannot be combined unless stated, are limited to one per customer unless stated, and may be withdrawn at any time. Bundle prices apply only to the bundle as configured. Free-shipping thresholds are calculated on the order value after discounts. We may cancel orders that abuse a promotion.
12. Intellectual property
All content on our website (text, photography, logos, product descriptions and packaging design) is owned by or licensed to Pudel Pty Ltd and protected by Australian copyright and trade mark law. It may not be reproduced or used without our written permission.
13. Reviews and content you submit
By submitting a review, photo, video or other content you grant Pudel Pty Ltd a perpetual, worldwide, royalty-free licence to use, edit and publish it in connection with our business, including on our website, packaging, advertising and social channels. You warrant that the content is yours, is accurate, and does not infringe anyone's rights or privacy. We may remove content at our discretion.
14. Acceptable use
You must not use our website for any unlawful or fraudulent purpose; submit false information; send unsolicited commercial messages; upload malicious code; attempt unauthorised access to our systems or data; scrape or harvest content; or impersonate another person.
15. Third-party links
Our website may link to third-party sites. We are not responsible for their content or practices, and a link is not an endorsement.
16. Your responsibility to us
To the extent permitted by law, you agree to compensate Pudel Pty Ltd for any loss, damage, cost or claim we suffer or incur that is caused by your breach of these Terms, by information you provided being false or inaccurate, by your misuse of a product contrary to the feeding guide or suitability notes, or by content you submit, in each case to the extent the loss was caused by you.
17. Limitation of liability
To the maximum extent permitted by law, including the Australian Consumer Law: (a) we exclude all liability for indirect, incidental, special or consequential loss, and for loss of profit, data or goodwill, arising from your use of our website or products; (b) our total liability to you in connection with any order is limited to the amount you paid for that order; and (c) we are not liable for any loss that results from your failure to follow the feeding guide, suitability notes or these Terms. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, and where liability cannot be excluded it is limited, at our option, to resupplying the product or paying the cost of resupply.
18. Website availability
Our website is provided "as is". We do not warrant that it will be uninterrupted or error-free, and we may modify, suspend or discontinue it at any time.
19. Governing law and disputes
These Terms are governed by the laws of New South Wales and the Commonwealth of Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales. Please contact us first; most issues can be sorted out informally and quickly.
20. General
If any part of these Terms is found to be invalid or unenforceable, that part is severed and the rest continues in force. Our failure to enforce any right is not a waiver of it. These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and us for your use of the website and your purchases. We may update these Terms at any time by posting the revised version with a new effective date; continued use after that constitutes acceptance.
